The law firm of MacKelvie & Associates, P.C. was founded in 1993 by Charles F. MacKelvie. In the course of his career, Mr. MacKelvie has been a practitioner of health care law, a legal advisor and business consultant for hospitals, health care systems, home health agencies, nursing homes, durable medical equipment companies, physicians and multi-specialty physician groups, factoring companies, lenders, and other types of businesses throughout the United States. Mr. MacKelvie has held equity interests in a number of health care companies. He has been a health care and business lawyer for 32 years. Mr. MacKelvie has a broad-based health care practice, primarily focused on Medicare, transactional, regulatory, administrative, non-profit corporate, tax and governance, and litigation matters. Mr. MacKelvie began his legal career as the Chief Hearing Officer of Medicare Appeals and Assistant Counsel for the Blue Cross Association ("BCA"), now d/b/a Blue Cross and Blue Shield Association. In that capacity, he adjudicated more than 100 Intermediary Medicare Appeals and argued in excess of 50 cases before the now Department of Health and Human Services' Provider Reimbursement Review Board ("PRRB"). Mr. MacKelvie argued the first case at the PRRB in August 1975. Upon leaving BCA, Mr. MacKelvie joined Ober, Grimes & Shriver ("Ober") in Baltimore, Maryland, where he helped build Ober's third party practice. Mr. MacKelvie was largely responsible for creating what is now the American Health Lawyers Association's Medicare and Medicaid Conference. Mr. MacKelvie joined McDermott, Will & Emery ("McDermott"), where he was the firm's first health care lawyer and was instrumental in building the firm's health law practice. While at McDermott, Mr. MacKelvie was responsible for managing more than 25 cases before the PRRB. Later, Mr. MacKelvie was a partner at Ross & Hardies, where he continued his career as a Medicare, business and tax attorney. While at Ross & Hardies, Mr. MacKelvie was in charge of the firm's third party reimbursement practice and argued more than 35 cases before the PRRB. In his career, Mr. MacKelvie has argued more than 300 cases at the PRRB, which is believed to be among the most reimbursement cases of any practitioner in the United States. He has been general and special counsel to numerous hospitals and health systems as well as numerous home health agencies and physician groups. He has also performed legal services in connection with numerous acquisitions, mergers, sales and joint ventures of health care entities. For a number of years, Mr. MacKelvie was the General Counsel for the American Federation of Home Health Agencies and Washington, D.C. counsel for the National League for Nursing. Mr. MacKelvie has served as an Adjunct Professor at Loyola University of Chicago's Institute for Health Law and the University of Florida Health Sciences Department. He has taught courses for more than 15 years on the Medicare and Medicaid Payment Systems and on Health Care Taxation and Alternate Delivery Systems. He also speaks before associations/professional organizations on a variety of legal and financial issues currently impacting hospitals, health care systems and alternate delivery systems. Mr. MacKelvie has published numerous articles and a book on topics such as: Joint Ventures; Mergers & Acquisitions of Health Care Entities; Duties and Liabilities of Health Care Corporations and their Directors; Fraud and Abuse; Health Care Finance; Charity Care Controversies and Retaining the Tax-Exempt Status of Not-for-Profit Hospitals. For many years, Mr. MacKelvie has served on numerous volunteer Boards of Directors of non-profit and business entities, including hospitals, home health agencies, fundraising foundations, and community organizations. He also served as a Member of the Illinois Educational Facilities Authority from 1988 to 2003.
