As a member of MacKelvie & Associates, P.C., Mr. Apolskis' practice encompasses work with health care organizations, such as hospitals, physicians, skilled nursing facilities, home health agencies, hospices, clinical laboratories, durable medical equipment suppliers, health plans, managed care companies, and related entities. In the course of his practice, Mr. Apolskis counsels clients on a wide variety of legal and regulatory compliance matters, including licensure, Medicare conditions of participation, billing, coding, privacy, anti-kickback, self-referral, and false claim matters. He also advises clients on compliance plans, and serves as counsel in governmental audits, investigations, prosecutions, and administrative proceedings. Furthermore, Mr. Apolskis has substantial experience advising clients on all aspects of Medicare and Medicaid reimbursement, including issues related to coverage, medical necessity, prospective payment systems, physician RBRVS, and cost-based reimbursement. He also represents health care providers and suppliers in Medicare and Medicaid reimbursement disputes and appeals. In addition, Mr. Apolskis' practice includes the formation and organization of health care-related entities, and providing general counsel to start-up and established organizations. He also has significant experience evaluating business ventures, and structuring and negotiating outsourcing, management services, pharmacy benefit management, managed care, and other agreements. Prior to joining MacKelvie & Associates, P.C., Mr. Apolskis served as Assistant General Counsel for the General Board of Pension and Health Benefits. In that position, he provided day-to-day and strategic legal advice involving the myriad of laws and regulations affecting health, welfare and cafeteria plans. He also provided extensive guidance regarding Medicare and Medicaid matters, tax-exempt organizations, managed care arrangements, third party payer disputes, and HIPAA's privacy standards. Formerly, Mr. Apolskis also served as Associate General Counsel and Assistant Vice President for Seaboard Life Insurance Company (USA), where he directed the company's legal and regulatory affairs. While in that position, he resolved a series of federal and state regulatory investigations, and successfully managed the company's corporate, employee benefits, and insurance litigation. His responsibilities also included counseling management in the areas of strategic business planning, new business ventures, and governmental affairs.
